Intellectual Property & Complex Litigation
We regularly devote ourselves to representing businesses, non-profit entities, and individuals in intellectual property, complex civil litigation, and other commercial matters.
Experienced Complex Litigation Attorneys
We have a depth of experience in litigating and trying complex civil litigation matters, including intellectual property, breach of contract, fraud, partnership, patent, trademark, and class action matters. We also regularly counsel and advise businesses, entrepreneurs, and non-profits on these and related issues.
Our complex litigation and commercial practice areas include:
Intellectual Property
The United States Constitution provides that Congress shall have the power “to promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries.” The founders recognized that a strong intellectual property system was critical to the nation’s success and history has proven them right. When intellectual property issues are at stake, you need an intellectual property lawyer with the ability both to understand complex technical and legal issues and tell a simple and passionate story to a jury.
We have successfully litigated intellectual property cases against some of the largest corporations in the world and the United States government. We have represented entrepreneurs in patent cases ranging from medical glove packaging to smartphone security, and consumer products to computer software. We have defended small businesses against trademark infringement and accusations of infringement. We generally handle these cases on a contingency basis, which aligns our interests with those of our clients and allows IP owners without the resources of large corporations to enforce their rights. And we represent online news organizations in Digital Millennium Copyright Act claims against OpenAI, the maker of ChatGPT.
We have represented clients in IP cases before the United States Supreme Court, the Federal Circuit Court of Appeals, multiple District Courts, and the Patent Trial & Appeal Board. Our IP Practice is led by Matt Topic, a former IP partner at one of the largest law firms in the world.
Representative cases include:
*Fusion Communications Corp. v. Fusion Media Network LLC, 14-cv-9760 (N.D. Ill.) (trademark infringement)
Supermax, Inc. v. *Jordan Fund, LLC, 14 CH 15979 (Cir. Ct. Cook Co.) (breach of contract)
SAS Institute, Inc. v. *Complementsoft, LLC, 16-969 (U.S. Sup. Ct.), 2015-1346 (Fed. Cir.) (patent infringement)
United States v. *Global Occupational Safety & Health Academy, LLC, 21-cv-2123 (N.D. Ill.) (trademark infringement)
*Brunner v. Dyve Biosciences, Inc., 19-cv-1663 (D. Del.) (patent ownership)
*Kim v. Samsung, 22-cv-367 (E.D. Tex.) (patent infringement)
Commercial Litigation
Navigating the intricacies of commercial litigation matters requires a legal team that has a thorough understanding of business law and the dedication to take on an often lengthy legal process. When your commercial interests are at risk, nothing less is acceptable. At Loevy + Loevy, the success of our commercial clients is the top of our priorities.
Our seasoned team brings to the table vast experience in business law. Loevy + Loevy’s attorneys were trained at some of the world’s most prestigious law schools and global firms, and are proven experts at state, federal, and appellate litigation. Most of our attorneys clerked before coming to our firm, many for federal appellate courts.
Whether you are a small business, individual entrepreneur, or large corporation, all of Loevy + Loevy commercial clients enjoy the service and value of a smaller law firm with the confidence of counsel who have won nearly 90 percent of our trials.
We handle commercial and business litigation matters throughout the nation. We represent both plaintiffs and defendants in commercial litigation. We are not looking to take just any commercial case, however. When we take a case, we are in it for the long haul, prepared to devote the maximum amount of energy and resources to achieving a favorable result for our client.
We have the skills and resources to handle even the most complex commercial and business cases, including those involving:
- Breach of contract
- Partnership and other closely held business disputes
- Fraud and breach of fiduciary duty
- White collar crime and internal investigations
Unlike most firms with our credentials and experience, we seek out opportunities to work on alternative fee bases, including flat rates and full contingency.
