Biography
Kyle Wallenberg is an attorney at Loevy + Loevy and a member of its Intellectual Property practice.
Kyle is an experienced intellectual property attorney. He has extensive experience in all stages of patent and trademark infringement litigation spanning a wide array of technologies, including battery systems; sporting equipment; power tools; medical devices and orthopedic products; LED lighting; RFID solutions; baby products; magnetic levitation products; software solutions; vision testing systems; and grills / grill accessories.
Kyle’s representative trial experience includes:
- Second chaired a patent infringement jury trial, representing a manufacturer of innovative baby products against an international company for infringing the client’s play gym patent, which resulted in a $3.2 million jury verdict for the client and affirmance on appeal to U.S. Court of Appeals for the Federal Circuit.
- Third chaired a trademark infringement jury trial, representing a renowned power tool company against a power tool manufacturer for infringing the client’s trademark and trade dress rights, which resulted in a $54 million jury verdict for the client and a favorable settlement.
Kyle has also represented many clients before the Patent Trial and Appeal Board in inter partes review proceedings and the Trademark Trial and Appeal Board in cancellation / opposition proceedings.
More recently, Kyle has represented several news publishers in copyright and Digital Millennium Copyright Act cases against creators of large language models, including OpenAI and Microsoft.
Kyle graduated from Chicago-Kent College of Law in 2013 with a specialization in Intellectual Property. During law school, Kyle was a member of the Giles Sutherland Rich Intellectual Property Moot Court Team and Chicago-Kent Intellectual Property Law Society. Kyle also externed for Judge James O’Hara in the Law Division of the Circuit Court of Cook County in Chicago, Illinois. Prior to law school, Kyle earned his Master of Science and Bachelor of Science in Materials Science and Engineering from the University of Illinois at Urbana-Champaign, where he concentrated in biomaterials and polymers.
