This notice is being sent to you by the United States District Court for the Northern District of Illinois because records show that you were processed into the Cook County Jail on or after January 30, 2004. A class action lawsuit entitled Young et al. v. County of Cook, case number 06-cv-552, may affect your legal rights. This notice concerns your rights in the class action lawsuit as well as how to exercise your rights. Please read this notice carefully.

You are covered by the class action if you fit within one or both of the following groups:

  1. All males who were subjected to a strip search and/or a visual body cavity search as a new detainee at the Cook County Jail on or after January 30, 2004;
  2. All people (male and female) charged with a misdemeanor or lesser offense not involving drugs or weapons who were subjected to a strip search and/or a visual body cavity search as a new detainee at the Cook County Jail on or after January 30, 2004.

The Court has not yet decided whether the class members will be entitled to money damages on their claims. Rather, this notice is being sent so that you can decide whether to remain in the class or separately pursue any claims you may have by removing yourself from the class action.

If you wish to be a part of the class action, you need not take any action at this time. Your rights will be determined with the rest of the class. Three individuals, Kim Young, Ronald Johnson, and William Jones, have been designated as “class representatives” to pursue this lawsuit on behalf of themselves and all class members. Additionally, all class members who remain in this lawsuit will be represented by attorneys Arthur Loevy, Michael Kanovitz, Jon Loevy, and Samantha Liskow, all with the Chicago law firm of Loevy & Loevy. Class members will not have any obligation to pay any costs or attorneys’ fees out of pocket. Any costs or fees will be awarded out of the damages recovered for the class.

If you wish to pursue your claims separately from the class action, you must mail the enclosed “opt out” form to Young Class Action c/o Michael Kanovitz, Loevy & Loevy, 312 N. May St., Suite 100, Chicago, IL 60607. Your form must be postmarked on or before February 12, 2009. If you do not return the form by that time, you will be a member of the class and be bound by the results in the case. By opting out, you will not be represented by class counsel and must proceed on your own.
