What is this lawsuit about?

This lawsuit affects people who have been arrested by the Chicago Police Department since March 15, 1999. The case is known as Dunn et al v. City of Chicago, Case No. 04-CV-6804. The people who sued are called Plaintiffs, and the entity they sued, City of Chicago, is called the Defendant.

This lawsuit claims that the City of Chicago violated the Class Members' rights under federal and state law due to the manner and/or length of the detentions. The suit seeks money damages from the City of Chicago for the members of the classes.

How do I know if I am a part of this case?

Class I consists of all persons detained in a Chicago Police Department interrogation or interview room for more than 16 hours in a 24-hour period at any time from October 21, 2002 to March 10, 2010. Persons in this class are eligible to receive up to $2,000.

Class II consists of all persons who were detained in a Chicago Police Department lock-up or detective facility from 10:00 p.m. (or earlier) on a given day and not released until 6:00 a.m. (or later) of the following day, at any time from October 21, 2002 to March 10, 2010. Persons in this class are eligible to receive up to $90.

Class III consists of all persons who were arrested on suspicion of a felony without an arrest warrant and who were detained by the Chicago Police Department and did not receive a judicial probable cause hearing within 48 hours of arrest, at any time from March 15, 1999 to February 10, 2008. Persons in this class are eligible to receive up to $3,000.

How do I get a claim form?

In the next couple of months, we will mail out a notice and claim form to people who, according to our records, are members of the class. Once you receive the claim form, you must fill it out and submit it, in order to be considered for payment.

How do I submit a claim for payment?

You must complete the Notice and Claim Form (see above). Once you submit the claim form, a claims administrator will review it and decide if you are a member of the class.

How much money will I receive?

A claims administrator will review your claim form and determine whether or not you are entitled to payment. The claims administrator will also determine the amount of money you are entitled to receive. If you are entitled to payment, it will take several months before the payment is mailed out. Please be patient.
